Terms of Sales and Conditions

Please read the following terms and conditions before placing an order through www.plesnerpatterns.no. The terms are subject to change at any time and should therefore be read every time you make a purchase

The person stated as buyer when ordering, hereinafter referred to as "you" or “customer".
Buyer and seller are collectively referred to as the “parties”.

  • General

Purchase of goods or services from Plesner Patterns is governed by the terms of these Terms of Sales and Conditions.

The Terms of Sales and Conditions do not impose any restrictions on the customer's non-mandatory rights under those governed by the Norwegian law referred to as Consumer Purchase Act, Marketing Act, Right of Withdrawal Act, Personal Data Act and E-commerce Act.

        - Patterns woven up to fabric, and sold by the meter

        - Patterns woven and sold as pillows, curtains, tablecloths, kitchen towels or scarfs

    - Patterns printed on fabric, sold by the meter

Orders, Pricing and Payments

Orders and agreements

The terms of purchase, together with the customer's order (confirmed by order confirmation), information given in the order server and any special agreement terms, constitute the total contractual basis for the purchase. In the event of any conflict between the information, what is specifically agreed between the parties will prevail, unless it is contrary to mandatory legislation. In addition, the agreement will be completed by relevant legal provisions regulating the purchase of item (s) and services between traders and consumers. 

The customer's order is binding when the order is registered on Plesner Patterns's server. Plesner Patterns is also bound by the customer's order if it does not differ from what is offered. The customer is nevertheless entitled to withdraw from the purchase in accordance with the right of withdrawal, see further information below.

Upon order, Plesner Patterns will confirm the order by automatically issuing an order confirmation. The customer should read carefully the order confirmation when it is received and check that it complies with the order. 

Deviations between the customer's order and the order confirmation are considered as a new offer from Plesner Patterns, which the customer can then accept or refuse. However, the customer has the right  to require the original order if this is still in accordance with what is offered on www.pleasnerpatterns.no. Exceptions may occur, for example, due to obvious pricing errors - see the section below on Prices. 

The agreement is not binding if there are typos or typos in the offer from Plesner Patterns on the website or on a written order confirmation, and the other party realised or should have realised that there was such an error. In the event of such significant typing or printing errors in advertisements, online stores, etc., Plesner Patterns can unilaterally change, delete or reject orders.

Pricing Terms

  • Purchases from www.plesnerpatterns.no

Products in Norway: All prices on quoted in the online store are inclusive of VAT (for products in Norway). Shipping costs come in addition unless expressly stated otherwise. The total cost of the purchase will appear before placing the order and include all expenses associated with the purchase, such as shipping, postage, packaging etc.

For products shipped outside of Norway the price is shown without VAT. There may be additional cost like VAT and/or custom charged by the country of import/destiny. For spesifications check with the import countrys customs. 

  • Services

For services to corporate customers, the price is excl. VAT. The price is agreed upon in accordance to individual project. 

Shipping costs

Shipping price in Norway is NOK 49 NOK pr. order up until 5 kg (shipping is carried out by Posten or Bring, but other suppliers can also be used if necessary). For orders to Norway, all prices are quoted including VAT and excl. freight. Plesner Patterns has the right at any point to modify prices on the website. Price changes will not be retroactive after ordering. 

Shipping price in Europe is NOK 150 NOK pr. order up until 5 kg

Payment

  • Ready-to-order item (s) (pillows)

Plesner Patterns may claim payment for the item (s) from the time the order is placed.

The customer can choose between the payment solutions Vipps, Stripe or invoice. When paying by debit or credit card, Stripe can reserve the purchase price on the card when ordering.

  • Ready-to-order item (s) (fabric by the meter)

Plesner Patterns may claim payment for the item (s) from the time the order is placed. 

The customer can choose between the payment solutions Vipps, Stripe or invoice. When paying by debit or credit card, Stripe can reserve the purchase price on the card when ordering.

  • Pre-order item (s)

Plesner Patterns may require payment in full or in part from the time the item (s) is ordered.

  • Services

If the assignment is canceled before it is completed, Plesner Patterns has the right to claim the agreed fee for the time used and material orders up to this times. When the design is completed, cost for time and materials will be invoiced. The remaining amount is invoiced upon delivery of the finished product, and is due 14 days from the invoice date. After the deadline, there will be additional interest rates.

Delivery, Shipping and Returns

Delivery and risk of the goods

Delivery of the products takes place in the manner, at the place and time specified in the order confirmation.

Plesner Patterns carries the risk of the products until the delivery of the product or service to the customer or to a representative appointed by the customer. Delivery is made when the customer, or his representative, has received the item (s) in his possession or the service is completed. 

In the event that the delivery of the product is delayed, Plesner Patterns will inform the customer as soon as Plesner Patterns has knowledge of the delay, as well as with information on and if possibly when delivery can occur, or if the product is sold out or not possible to make.

Depending on the nature of the product and the length of the delay, the customer may withhold the payment, demand delivery or cancel the agreement. 

If the delivery date is stated in the order, Plesner Patterns shall deliver the item (s) to the customer without undue delay and no later than 30 days after the order is placed from the customer. The item (s) are delivered to the customer unless otherwise agreed between the parties. Delivery of services is contractually agreed. 

  • Uncollected packages

If the customer fails to collect the item (s) by the specified date, these will be returned to Plesner Patterns. For uncollected packages a fee of NOK 199 will be charged. The customer will subsequently be charged again for shipping the item (s).

Right of withdrawal

  • Ready-to-order item (s) (kitchen towels, pillows and more)

The costumer has a 14 day withdrawal period. The customer is obliged to inform Plesner Patterns via email if the costumer wished to exercise the right if withdrawal. The deadline includes all calendar days. If the deadline falls on a Saturday or a public holiday, the deadline is extended to the next working day. Plesner Patters will subtract NOK 99 from the amount to be refunded if the customer chooses to return the item (s). The withdrawal period is considered to be met if the package is sent before the expiry of the deadline. The customer has the burden of proving proof that the right of withdrawal is exercised, and the notification should therefore be made in writing via e-mail.

  • The period of withdrawal starts when:

- When purchasing individual item (s), the withdrawal period will run from the day after the item (s) is delivered.

- If the purchase consists of several deliveries, the withdrawal period will run from the day after the last delivery has been delivered. 

When using the right of withdrawal, the item (s) must be delivered to Plesner Patterns without undue delay. In addition to the direct return costs, the customer will not be charged any additional costs as a result of the customer exercising the right of withdrawal, as long as the item (s) are returned in the same condition and quantity as they were received. The customer may be responsible for any reduced value of the item (s) if the item (s) is not returned in the same condition it was received.

If the right of withdrawal is used, Plesner Patterns will refund the payment within 14 days from Plesner Patterns was notified of the customer's decision to use the right of withdrawal. Plesner Patterns is entitled to withhold payment until the item (s) has been received from the customer or until the customer has provided documentation that the item (s) have been returned.

  • Ready-to-order item (s) (fabric by the meter)

The customer has a 24 hour withdrawal period. The customer must inform Plesner Patterns via e-mail if the customer wishes to exercise the right of withdrawal. The withdrawal period starts running the day after the item (s) is ordered.

  • Pre-order item (s)

The customer has a 24 hour withdrawal period. The customer must inform Plesner Patterns via e-mail if the customer wishes to exercise the right of withdrawal. The withdrawal period starts running the day after the item (s) is ordered.  

  • Services

The customer has a 24 hour withdrawal period. The customer must inform Plesner Patterns via e-mail if the customer wishes to exercise the right of withdrawal. The withdrawal period starts running the day after the service is ordered.

  • Refund

If the purchase is completed by credit card, the balance will be refunded to the same card that was used to complete the purchase. When purchasing using Vipps, Vipps will be used for repayment.

  • Delays and failure to deliver

In the event that Plesner Patterns fails to deliver the item (s) or delivers it too late in accordance with the agreement between the parties, and this is not due to the customer or circumstances on behalf of the customer, the customer may withhold the purchase price in accordance with the rules of the Consumer Purchase Act, according to the circumstances and/or terminate the agreement. In the event of claims for breach of agreement, the notification of proof should be sent in writing via e-mail.

  • Fulfillments

The customer can maintain the purchase and demand a fulfillment from Plesner Patterns. However, the customer cannot claim fulfillment if there is an obstacle that Plesner Patterns cannot overcome, or if fulfillment will cause a great disadvantage or cost to Plesner Patterns. Should the difficulties fall away within a reasonable time, the customer may still demand fulfillment. The customer loses his right to demand fulfillment if he or she waits unreasonably long to advance the claim. 

  • Withdrawal

If Plesner Patterns fails to deliver the item (s) or services at the agreed delivery time, the customer shall encourage Plesner Patterns to deliver within a reasonable additional deadline. If Plesner Patterns does not deliver the item (s) or services within the additional deadline, the customer may cancel the purchase. However, the customer may cancel the purchase immediately if Plesner Patterns refuses to deliver the item (s) or services. The same applies if delivery at the agreed time was crucial for the conclusion of the agreement or if the customer has previously informed Plesner Patterns that the delivery time is crucial. If the item (s) or services are delivered after the additional deadline the customer has set or the delivery date which was decisive for the conclusion of the agreement, the costumer must make a claim for cancellation within a reasonable time after the customer was informed of the delivery. 

  • Compensation

The customer may claim compensation for some loss as a result of the delay. This does not apply if Plesner Patterns proves that the delay is due to an obstacle beyond Plesner Patterns control which could not reasonably have been taken into account at the time of the agreement, avoided, or overcome the consequences. 

  • Faulty item (s) and guarantee

If there is a defect in the item (s), the customer must notify Plesner Patterns within a reasonable time after it was discovered or should have been discovered. The customer must complain within two months of the defect being discovered or should have been discovered. The guarantee expires after two years of the customer taking over the item (s). If the item (s) has a defect and this is not due to the customer or circumstances on the customer's part, the customer may, according to the rules in the Consumer Purchase Act, Chapter 6 withhold the payment, choose between having the item (s) corrected and redelivered, demand a discount, demand the agreement canceled or demand compensation from Plesner Patterns. However, the customer is obliged to maintain the goods in accordance with the supplier's recommendation. All fabrics will fade in direct sunlight, and this will not count as an defect in the product.

  • Correction or redelivery

The customer can choose between demanding the defect corrected or delivery of the corresponding item (s). However, Plesner Patterns may oppose the customer's claim if the execution of the claim is impossible or incur unreasonable costs for Plesner Pattern. Correction or delivery must be made within a reasonable time. Plesner Patterns does not initially have the right to make more than two attempts in correcting the same deficiency.

  • Price reduction

The customer may demand an appropriate price reduction if the item (s) or services are not corrected or delivered. This means that the ratio between the discounted and the agreed price corresponds to the ratio between the value of the product in defective and contractual condition. If there are specific reasons for this, the price reduction can instead be set equal to the lack of significance for the buyer.

  • Plesner Patterns' rights in the event of customer default

If the customer fails to pay or fulfill the other obligations under the agreement, and it is not due to Plesner Patterns or circumstances on Plesner Pattern's part, Plesner Patterns may, under  the Consumer Purchase Act, Chapter 9 withhold the item (s), demand fulfillment of the agreement, demand the agreement terminated as well as demand compensation from the customer. Plesner Patterns may also claim interest on late payment, collection fees and a reasonable fee for uncollected goods.

  • Fulfillment

Plesner Patterns may maintain the purchase and/or require the customer to pay the purchase price. If the item (s) is not delivered, Plesner Patterns loses their right if Plesner Patterns waits unreasonably long to advance the claim. 

  • Withdrawal

Plesner Patterns may terminate the agreement if there is significant payment default or other breach from the customer's side. However, Plesner Patterns cannot withdraw if the entire purchase price is paid. If Plesner Patterns sets a reasonable additional deadline for fulfillment and the customer does not pay by this deadline, Plesner Patterns may cancel the purchase. 


Rights and Information

Ownership Rights

The product cannot be copied for use in other contexts without Plesner Patterns consent. Plesner Patterns retains all rights to originals, ideas, sketches, drafts and other materials, even if the assignment is canceled before it is completed. Plesner Patterns has the right to use the originals in its own marketing. The work is credited to the designer where it is natural.

All content on www.plesnerpatterns.no that is available belongs to Plesner Patterns. The information is protected including through intellectual property and marketing laws. Trademarks, company names, product names, images, graphics, designs, layouts and product information, or other content cannot be reused without Plesner Pattern's prior written approval. 

Information provided at www.plesenerpatterns.no

While Plesner Patterns strives to give the customer as accurate a description of the product as possible, printing/printing errors, minimal colour variations from the image to the actual product may occur due to a variety of factors, such as which colour settings and contrasts are set for the screen or which browser is used. Plesner Patterns cannot be held responsible for colour differences according to information provided on www.plesenerpatterns.no, through marketing or otherwise. To ensure that the product meets customer needs, Plesner Patterns recommends ordering textile samples in advance.

Plesner Patterns reserves the right to cancel an order if the product is sold out. The customer should be informed of this along with information about alternatives Plesner Patterns can offer instead. The costumer will have the opportunity to accept a new offer or cancel the order. 

Plesner Patterns reserves the right to discontinue use of www.plesenerpatterns.no at any time, for example, during maintenance.

Privacy Notice

How we collect information:
We collect data from you when you register on our site, make a purchase or participate in a competition. The overall information includes your name, email address, phone number. In addition, we automatically receive and record information about your computer and browser, including your IP address, software and hardware, as well as the page you request.

Non-personal information however, may be provided to other parties for marketing, advertising or other purposes.

We implement a variety of security measures to maintain the security of your personal information. We use encryption to protect sensitive information transmitted online. Only employees who need to perform a specific job (such as billing or customer support) will have access to personally identifiable information. The computers/servers used to store personally identifiable information are kept in a secure environment.

Pursuant to the Data Protection Act, you have the right to request access, correction, deletion, restriction, data transfer and withdraw consent. If you wish to exercise any of the rights listed above, you can contact us by email. 

We have the right to request specific information from you to confirm your identity and to ensure that you have the right to access your personal information.

We use cookies to improve access to our site and identify repeat visitors. In addition, our cookies enhance the experience for the user by tracking and targeting his/her interests. However, this cookie use is in no way linked to personally identifiable information on our site.
